Energy
The energy area is at times extremely complex, requiring, apart from legal skills, a high degree of insight in this particular business and the commercial challenges faced by the energy sector.
For the purpose of providing actually value-adding counselling in this specific area, it is essential to the adviser to allow for not only the legal, but also the technical, financial and commercial problems.
Such insight can only be acquired by continuously advising the operators in this line of business, which is what HjulmandKaptain’s energy and infrastructure team has been doing for a number of years – in relation to both Danish and foreign clients.
Owing to the national objective, among other things, to supply 30% of Denmark’s energy consumption in 2020 by means of renewal energy, HjulmandKaptain has invested considerable resources in this specific area, such as consultancy competence in problems related to offshore and onshore wind turbines, of which Danish operators occupy an essential part.
In addition, we make use of the opportunity of posting our own employees with our clients for short- or long-term periods for the purpose of preserving an even closer contact with the business and the challenges thereof. These achieved skills are highly beneficial to our clients, our client portfolio consisting of both major Danish and foreign energy operators, including cleantech companies, suppliers, operators, public authorities and utility companies.
One of the characteristics of the business is the demand for acting promptly and flexibly – at certain critical stages of the process. On those grounds, among other things, HjulmandKaptain has prioritized the establishment of a dedicated team, being capable of giving advice within this, sometimes, demanding area – also within a very tight timeframe and a very brief response time. Further, we have established a strong international network, enabling us to advise across national borders.
Infrastructure
The area of major building and construction projects is growing again, which is obvious, among things, in the area of publicly-funded projects. HjulmandKaptain is often the selected consultant, when it comes to advising on these complex public and private building and construction projects.
We act as consultants to both public authorities and private operators. This approach has provided HjulmandKaptain with an insight in all major problems attached to any major construction project, which is beneficial to our clients – whether they are constractors, employers, architects, consulting engineers, fully or semi-public authorites, or insurance companes.
In that connection, HjulmandKaptain assists our clients in connection with the building and construction of e.g. hospitals, enlargements of road systems, light rail systems, harbours, etc.
Having sympathy for the commercial and financial challenges, when determining the motives of the operators involved, our focus is always solution-oriented.
Naturally, we offer our assistance, when the problems arise, but our group of lawyers can also provide advice prior to any dispute, as considerable resources may often be saved, if e.g. the contracts are subject to a quality control before signing. It is our experience that some of the challenges to the business are the result of the use of standardized contracts without due and proper focus on the specific risks involved in the individual project.
If the result is a dispute that is unsolvable without the involvement of the civil courts of law or an established arbitration tribunal, HjulmandKaptain considers legal and arbitral disputes a core area, having thus decided to establish a specialist team with dispute resolution as its primary priority area, of which disputes within the building and construction sector occupy a major part. This is the reason, why precisely construction law and litigation and arbitration proceedings are all primary priority areas to several of our lawyers.
